Your car was totaled: who gets the check, and what happens next
Short answer
Insurance pays the car's value, not your loan.
- The CFPB says GAP coverage is meant to cover the difference.
- In New Jersey, the check can go to your lender, or to you both jointly.
- The offer adds sales tax.
- If it won't buy a comparable car, you have 30 days to say so in writing.

Where are you?
Pick the closest one. It shows who usually pays and the New Jersey rule behind it. It can't tell you what your car is worth or who was at fault.
- What it is
- The car's value to a retail buyer, plus sales tax.
- Why it matters
- New Jersey's total loss rule covers collision and comprehensive claims.
- The rule
- Its written, itemized valuation goes to you by the payment date. A dealer quote it uses must come from within 25 miles of where the car is kept.
Ask in writing which source it used to value the car, and keep the valuation.
- What it is
- Your car's value, from their property damage liability coverage.
- Why it matters
- New Jersey applies its total loss rule to the other driver's insurer once liability becomes reasonably clear.
- The rule
- That insurer must say whether it will pay for a comparable rental, which runs until the claim is settled. It generally pays within 45 calendar days of notice. You can also claim under your own collision coverage.
Ask their adjuster in writing about the rental and the valuation, and keep every letter.
- What it is
- Insurance pays up to the car's value, not what you owe.
- Why it matters
- New Jersey's salvage title law describes a total loss claim paid to the lender, or to the lender and the owner jointly.
- The rule
- GAP coverage, if you have it, is meant to cover the difference between what you owe and what the insurer pays.
Ask your lender for the payoff amount, and check your loan or lease papers for GAP.
- What it is
- The payment, minus the car's salvage value.
- Why it matters
- The insurer subtracts what the wreck is worth to it.
- The rule
- In New Jersey, that deduction can't exceed what a nearby salvage facility would pay you. You have 30 calendar days to dispute it in writing. Once rebuilt, it needs an inspection report for a salvage certificate.
Tell the insurer as soon as possible, and photograph the car before any repair.
- What it is
- Proof of what a comparable car sells for near you.
- Why it matters
- A regulator's advice: be ready to show what the car would sell for in your area.
- The rule
- In New Jersey, write within 30 calendar days of getting the check that you can't buy a comparable car for that value. The insurer must reopen the claim.
Collect quotes from used car dealers and local ads for the same car, and send them in writing.
- What it is
- The injury claim runs apart from the car.
- Why it matters
- The other driver's insurer handles property damage and injury claims on separate clocks.
- The rule
- In New Jersey, it has 45 calendar days for property damage and 90 calendar days for an injury claim, from notice. Your own PIP pays medical bills first.
Read anything you sign for the car, so it settles only the car.
When is a car considered totaled?
The insurer decides, by weighing the repairs against the car's value.
If repairs cost about the same as the car is worth, or more, the insurer will likely total it, the Texas Department of Insurance says.

Questions people ask
Who gets the insurance check when a car is totaled?
If the car is paid off, you do. If you owe on it, the check can go to your lender, or to you and your lender jointly: New Jersey's salvage title law names both. Ask your insurer and your lender how the payment will be split.
What happens if my car is totaled and I still owe money on it?
Insurance pays up to the car's value, not what you owe, so you can still owe the lender the rest. The CFPB says GAP coverage is meant to cover that difference, if you bought it.
What happens if my car is totaled and it wasn't my fault?
The other driver's property damage liability coverage pays your car's value. In New Jersey, their insurer must follow the same total loss rule once liability is reasonably clear, and say whether it will pay for a rental.
Can a totaled car be fixed?
You can ask to keep it. The insurer subtracts the car's salvage value from what it pays you. In New Jersey, a rebuilt car gets a salvage certificate of ownership, issued only with an inspection report.
How much will insurance pay for a totaled car?
Its value to a retail buyer, not a number Counselworthy can give for your car. In New Jersey, the offer adds sales tax and comes with a written, itemized valuation by the payment date.
How do you know if your car is totaled?
The insurer tells you. It weighs the cost of repairs against the car's value, and will likely total it when repairs cost about as much as the car is worth, or more.
